Right of Withdrawal
Note: As of [date / 01.10.2025], a flat return fee of €2.95 will apply to returns (withdrawals).
(1) When concluding a distance selling transaction, customers generally have a statutory right of withdrawal, about which Gate194 will inform you in the following in accordance with the statutory model. The exceptions to the right of withdrawal are regulated in clause (3). Clause (4) contains a model withdrawal form.
Consumers have a right of withdrawal within 14 days.
(2) Right of withdrawal
You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Overkill GmbH, Köpenicker Str. 195 A, 10997 Berlin, Germany, info@overkill.de, telephone: +49 30 698 183 79) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or e-mail).
You may also exercise your right of withdrawal via our online withdrawal function available on our website under "Withdraw Contract". After submitting your declaration through the online withdrawal function, we will promptly confirm receipt by e-mail.
You may use the attached model withdrawal form for this purpose, but this is not mandatory.
To comply with the withdrawal period, it is sufficient to send the notification concerning the exercise of your right of withdrawal before the end of the withdrawal period.
(3) Consequences of withdrawal
If you withdraw from this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (other than any additional charges arising from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date on which we receive notice of your withdrawal from this Agreement.
For this refund, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no event will you be charged for this refund.
We may refuse to make any refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us or to Overkill GmbH (Aufgang W. 2. OG), Wolfener Str. 36, 12681 Berlin, Germany, immediately and in any case no later than fourteen days from the day on which you inform us of your withdrawal from this contract.
The deadline is deemed to have been met if you send the goods before the end of the fourteen-day period.
You shall bear the direct costs of returning goods in the amount of €2.95 per return. The actual costs of the return are higher; the difference will be covered by the retailer. The return costs do not apply if the delivered goods are defective or incorrect. The amount of €2.95 will be deducted from your refund.
You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.
(4) The right of withdrawal does not apply to the following contracts:
- Contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
- Contracts for the supply of sound or video recordings or computer software in a sealed package, if the seal has been removed after supply.
- Contracts for the supply of newspapers, periodicals or magazines other than subscription contracts.
(5) Model withdrawal form
You may alternatively submit your withdrawal declaration via our online withdrawal function available under " Withdraw Contract". The following model withdrawal form may also be used, but its use is not mandatory.
